Scottish Law Commission discussion paper: damages for wrongful death

This paper stems from a reference from Scottish ministers in September 2006 inviting the Commission "to consider the law relating to damages recoverable in respect of deaths caused by personal injury and the damages recoverable by relatives of an injured person; and to make any appropriate recommendations for reform".

Joint Law Commission discussion paper on insurance contract law: misrepresentation, non-disclosure and breach of warranty by the insured

This paper largely focuses on misrepresentation and non-disclosure and explores the issues around what happens when claimants make mistakes in application forms or when they fail to mention facts which the insurer would regard as relevant.
